Terms and Conditions – Consignment

  1. INITIAL COLLECTION OF YOUR ITEM
    1. Where you choose to have your item for consignment collected by our courier, we will arrange this and will pay the courier fee. You must ensure that you attend at your nominated collection address at the time window agreed with the courier for collection and follow our directions for shipping.
    2. Where you choose to have your item for consignment shipped to us via Australia Post, you must print the post label provided by us and attend at an Australia Post office to arrange to post your item to us. For all methods of shipping, you must securely pack your item in a sturdy box in a manner which sufficiently protects your item whilst being shipped.
    3. Upon receipt of your item by us, we will arrange for our authenticators to inspect your item to verify its authenticity and we will physically inspect your item to ascertain its condition. For watches sent to us on consignment, you consent to the watch being opened for inspection by our expert watchmaker to assess the authenticity and condition.
    4. We will then email you to confirm we have authenticated your item. The price will be that quoted to you, unless the condition or any features of your item are different to what they appeared when you originally submitted your consignment request to us. We advise that our selling price is based on the best selling price that we consider can be achieved having regarding to the market price of the item against similar items in the market. If the price necessitates a change, then we will advise you and then you must email us to confirm that you are satisfied with our proposed listing price, upon which we will clean your item (if necessary) and list your item on our website.
    5. If you advise that you are not satisfied with the proposed listing price, then we will arrange for the return of your item to you at your cost.
    6. If upon inspection our authenticators determine your item to be a replica, then we will ship back your item to you only upon payment of a $150 charge per item for Australian consignors in order to cover our costs incurred and processing, or a $200 charge for international consignors, or a $250 charge per item for replica watches. If a watch is not in good working order or not in the condition described, then we will ship back the watch to you upon payment of a $250 charge, to cover our costs of engaging our watchmaker for authentication and assessment along with our processing, postage and other costs incurred. If you do not pay us the relevant fee within a reasonable time of request so as to enable us to return the item to you (which is, at the latest, within 14 days of being advised of the assessment), the fee will remain payable although the item will be disposed of, or in the case of watches not in good working order will be either disposed of or sold at our nominated price solely to recoup our fees which have not been paid. In the case where multiple replica items are submitted, we may at our discretion offer a combined replica fee rather than the fee per item however if that is not paid within 14 days of being notified, the charge per item above will apply. Charges for replica items above may at our discretion be offset against any other monies payable by us to you.
    7. In providing your item to us for consignment, you warrant that the item is authentic and produced by the designer stated and that you have sole and unencumbered title to the item. If you have previously been offered an option to proceed with direct sell, your election to proceed with the consignment option is unequivocal and cannot be changed once the bag has been listed on the site.
  2. LISTING ON OUR WEBSITE
    1. We will list your item on our website for the price agreed with you and otherwise with a description and in a manner which we consider best maximises the prospect of sale. You agree for your item to be listed on our website for 90 days from the initial listing date. Throughout the listing we may contact you and ask whether you wish to reduce the sale price, which is at your discretion to do so.
    2. We will advise you once your item sells and will arrange to pay into your nominated bank account the sale price of the item less our consignment fee as set out at clause 3.
    3. In the event that your item does not sell within the 90 day listing period, we will contact you and it is at your discretion as to whether to agree to continue listing the item for the same or a less price, or whether you direct us to return your item to you upon which case we will pay for the shipping cost to return your item to you.
    4. In the event that you seek the return of your item prior to the end of the agreed 90 day listing period, an administrative charge of 50% of the consignment fee will be payable by you to us to cover our costs which include processing, listing and shipping.
  3. CONSIGNMENT FEE
    1. Upon the sale of your item to one of our customers, we will pay the following monies into your nominated bank account following 7 days after the item has been received by the buyer (ie. the expiry of our 7 day returns period when the sale is concluded), or in the case of jewellery/watches this is paid 7 days following the sale: 70% of the sale price less a $30 authentication fee, where the sale price is less than $4,000.00; or 80% of the sale price less a $30 authentication fee, where the sale price is $4,000.00 or more, and we retain the balance of the sale price as our consignment fee.
    2. We will cover the cost of any GST and shipping fees to the customer. The above fees apply to each item individually (where more than 1 item is being consigned).
    3. Upon payment of the net sale price to you, your sale to us is finalised, with the exception of any items which are found not to be authentic at any point, in which case we reserve the right to claim back the payment in return for the non-authentic item to you, which amount will be payable upon demand or if applicable offset against any other monies owing to you together with charging our replica fee.
  4. GENERAL
    1. For all shipments sent from within Australia, you assume all responsibility and risk for your item until it is collected by our courier, or received by Australia Post as reflected in the tracking (as the case may be depending on which shipping option you choose). Upon scanning in by our courier or lodgement with Australia Post as evidenced by the tracking, we assume the responsibility and risk whilst in transit if the shipment is lost in transit. International sellers outside of Australia bear the responsibility and cost for their shipment including while in transit.
    2. For shipments sent from within Australia above in the event that any loss to your item whilst in transit, then we will be responsible to you for the cost of such loss of damage, limited to the value of our payout that we have quoted to you in our quote email.
    3. We will otherwise not be liable to you in any circumstances for loss, damage or any claims, provided we have complied with our obligations as set out in these Terms and Conditions, including without limitation if you leave your item unattended prior to collection by the courier or Australia Post, and in no circumstances will we be responsible for any consequential loss.
    4. You indemnify us for any loss, damage or claim incurred by us as a result of your negligent act or omission or breach of these terms and conditions.
    5. In that event that you do not comply with a provision of these terms and conditions, then we may advise you that we wish to end the consignment arrangements between ourselves and (if applicable) you will pay the shipping fee for us to return your item to you.
    6. We reserve the right to discontinue with the sale of your item for any reason and will not be liable in any manner upon discontinuance.
    7. We will use our best endeavours to sell your item, but we cannot provide any guarantee that your item will sell.
    8. Upon us communicating with you by email on any matters relating to the item, you agree that you access your email account regularly such that you can revert to us promptly on all matters.
    9. From time to time we may have in place a referral program to incentivise referrers to refer sellers to us. In submitting your quote form to us you can elect to complete in the referral field the name of a person who referred you to us. If you choose to do this, you expressly authorise us and acknowledge that we may disclose key details regarding the sale of your item to the referrer to the extent necessary to conduct the referral program. These details include without limitation the item name, your name, selling price and selling date. If you do not wish for these details to be disclosed to your referrer, then do not complete the referral field in the quote form.
    10. The link to these terms and conditions will be provided to you in an email prior to you sending your item for consignment, and by shipping your item to us your actions constitute acceptance of these terms and your intention to be bound by them. These terms and conditions represent the entire agreement between yourself and us regarding your consignment of your item, and no variation to these terms and conditions is made unless the parties mutually confirm by email to make such variation.
    11. In these terms and conditions, ‘your’ and ‘you’ refers to the person named above. ‘Us’ and ‘we’ refers to Luxe.It.Fwd Pty Ltd. ‘Item’ refers to your item that is proposed to be consigned.
