Terms and Conditions โ€“ Consignment

1.       INITIAL COLLECTION OF YOUR ITEM

(a) For collections in metropolitan areas – We will arrange with you for our nominated courier to collect your item, being the agreed handbag, jewellery or shoes, and we will pay the courier fee. You must ensure that you attend at your nominated collection address at the time window agreed with the courier for collection and follow our directions for shipping.

(b) For collections in regional areas – You must print the registered post label provided by us and attend at an Australia Post office to arrange to post your item to us.

(c) For all methods of shipping, you must securely pack your item in a sturdy box in a manner which sufficiently protects your item whilst being shipped.

(d) Upon receipt of your item by us, we will arrange for our authenticators to inspect your item to verify its authenticity and we will physically inspect your item to ascertain its condition.

(e) We will then email you to confirm we have authenticated your item and the price we will list your item on our website. The price will be within the range previously advised to you, unless the condition or any features of your item are different to what they appeared when you originally submitted your consignment request to us. We advise that our selling price is based on the best selling price that we consider can be achieved having regarding to the market price of the item against similar items in the market.

(f) You must email us to confirm that you are satisfied with our proposed listing price, upon which we will clean your item (if necessary) and list your item on our website.

(g) If you advise that you are not satisfied with the proposed listing price, then we will arrange for the return of your item to you at your cost.

(h) If upon inspection our authenticators are unable to verify the authenticity of your item, then we will return your item to you upon payment of a $65 charge per item in order to cover our courier costs incurred both ways and processing. If you do not pay us this fee within a reasonable time of request so as to enable us to return the item to you (which is, at the latest, within 14 days of being advised of the replica assessment), the fee will remain payable although the item will be destroyed without further notice as we do not store replica items. Where multiple replica items are submitted, we may at our discretion offer a combined replica fee rather than the fee per item however if that is not paid within 14 days of being notified, the charge per item above will apply. Charges for replica items above may be offset against any other monies payable by us to you.

(i) In providing your item to us for consignment, you warrant that the item is authentic and produced by the designer stated and that you have sole and unencumbered title to the item.

 

2.        LISTING ON OUR WEBSITE

(a) We will list your item on our website for the price agreed with you and otherwise with a description and in a manner which we consider best maximises the prospect of sale. You agree for your item to be listed on our website for 90 days from the initial listing date.

(b) Throughout the listing we may contact you and ask whether you wish to reduce the sale price, which is at your discretion to do so.

(c) We will advise you once your item sells and will arrange to pay into your nominated bank account the sale price of the item less our consignment fee as set out at clause 3.

(d) In the event that your item does not sell within the 90 day listing period, we will contact you and it is at your discretion as to whether to agree to continue listing the item for the same or a less price, or whether you direct us to return your item to you upon which case we will pay for the shipping cost to return your item to you.

(e) In the event that you seek the return of your item prior to the end of the agreed 90 day listing period, an administrative charge of $55.00 will be payable by you to us to cover our previous shipping and listing costs, and you must also pay the shipping cost to return the item to you.

 

3.        CONSIGNMENT FEE

(a) Upon the sale of your item to one of our customers, we will pay the following monies into your nominated bank account following 14 days after the item has been shipped to the buyer (ie. the expiry of our 14 day returns period when the sale is concluded):

- 70% of the sale price, where the sale price is less than $4,000.00; or

- 80% of the sale price, where the sale price is $4,000.00 or more,

and we retain the balance of the sale price as our consignment fee.

(b) We will cover the cost of any GST and shipping fees to the customer. The above fees apply to each item individually (where more than 1 item is being consigned).

(c) Upon payment of the net sale price to you, your sale to us is finalised, with the exception of any items which are found not to be authentic.

(d) You acknowledge that we offer lay-bys to customers across all of our items for a period of either 1 month or 2 months and that a sale of your item may be by outright sale to the customer or by completion of lay-by instalments by the customer.

 

4.        GENERAL

(a) When sending by our courier, you assume all responsibility and risk for your item until it is collected by our courier. Upon collection by our courier, we assume the responsibility and risk whilst in transit and in our possession. Alternatively, if you elect to send your item to us by Australia Post, you must obtain the tracking number from Australia Post at the time of shipment and email this to us at the time of sending.

(b) In the event that any loss or damage occurs to your item whilst in transit with our courier or in our possession and is not caused or contributed to by your negligent act or omission, then we will be responsible to you for the cost of such loss of damage, limited to the market value of your item.

(c) We will otherwise not be liable to you in any circumstances for loss, damage or any claims, provided we have complied with our obligations as set out in these Terms and Conditions, and in no circumstances will we be responsible for any consequential loss.

(d) You indemnify us for any loss, damage or claim incurred by us as a result of your negligent act or omission or breach of these terms and conditions.

(e) In that event that you do not comply with a provision of these terms and conditions, then we may advise you that we wish to end the consignment arrangements between ourselves and (if applicable) you will pay the shipping fee for us to return your item to you.

(f) We reserve the right to discontinue with the sale of your item for any reason and will not be liable in any manner upon discontinuance.

(g) We will use our best endeavours to sell your item, but we cannot provide any guarantee that your item will sell.

(h) Upon us communicating with you by email on any matters relating to the item, you agree that you access your email account regularly such that you can revert to us promptly on all matters.

(i) These terms and conditions represent the entire agreement between yourself and us regarding your consignment of your item, and no variation to these terms and conditions is made unless the parties mutually confirm by email to make such variation.

(j) In these terms and conditions, ‘your’ and ‘you’ refers to the person named above. ‘Us’ and ‘we’ refers to Luxe.It.Fwd Pty Ltd. ‘Item’ refers to your item that is proposed to be consigned.
